Should the landlord pay for insect extermination?
Question:I moved into a house with roommates and soon after I started noticing spiders and other bugs, daily. Then, recently I started noticing ants everywhere, as well. I keep my room clean, so I have no idea why there are so many..but the landlord wants to add the cost of the extermination to our rent. Shouldn't the landlord pay be the one paying?
Answers:
Yes, and if he won't you pay it yourself, and take it out of the rent.
On the other hand, if the landlord is planning on regularly doing professional extermination on the whole building, he can raise the rent for all units because it is an expense. But if it's only for your place, and no one else's, he can't raise your rent because of it.
Since you said you rent a house, I'm assuming that you and your roommates are the only tenants - it can go either way, then, depending on if it's a one-time extermination (no rent raise) or a regular monthly extermination (he could raise the rent).
Take note that ants and spiders are usually seasonal, and usually no one's fault. If they bother you that much, you may also want to go in half with your landlord, since it will be both protecting your interest as well as his.
Yes, it is his property, therefore, his responsibility.
The only way you would be on the hook is if you brought insects in and they got looose. Say an ant hill.
YES, that is landlord's responsibility. Go to your courthouse & ask for the booklet on landlorn tenant law and then you'll know your rights and his duties !!!
Yes, it is his/her responsibility. Unless the tenants have trashed the house and are inviting roaches and ants (this is where monthly inspections come in handy), the landlord is responsible for infestations of any sort, in order to provide a clean and safe environment for the renters.
Do not let the landlord bully you into making you pay (and I'm saying this AS a landlord). From the experience of colleagues, you will win if the issue goes into the hands of a court and/or moderator. Again, that is if your roommates haven't utterly trashed the home.
Good luck!!
Tough question, I used to work on rentals. If you hold a lot of parties.. do not keep you apt clean, pizza boxes, chinese cary out staying out, do to no take the trash out... where are they coming from and what is attracking them. one house I did a guy use dto party with his friends in a spare room to keep it quiet... lots of spilled drinks and food, that is thier problem, another place a woman kept flushing things down the toliet that should not go there then her son / trying to be a grown up/ put his diaper in the toilet.holy cow... man... all that backage can flooding up in the basement, again the person renting is going to pay. they should of know by the leakage around the toilet. another place I worked on, the neighbor had 4-6 cats... all in his basment.. they all had fleas, when it rained it flooded the tenents basement full of fleas. now that is the landlords problem
it is a local issue, are you doing everything you can and that is required to prevent this, if so take it to sourt and you will win.. landlords like to bluff, sometimes you do not need legal action, a few pictures of the problem... send them to him.. and he will cosult with his legal team and most of the time they will pay. pictures go a log ways.. if you really do not believe you are casuing the problem suggest you send the picturs to local agentcies... he might come and inspect but if is not you the landloard will pay
Yes I feel that he should pay but you live in a house and not an apartment that could mean a whole different situation. You and your roommates might just want to get the exterminnation done on your own
yes , he or she is the property owner , therefore it is there obligation,if they persist in doing nothing contact your local JP and or news station
Don't pay him/her anything. Take your lease agreement to your lawyer.
Yes, it is absolutely the landlords responsibility in all cases EXCEPT: if the infestation is due to filthy conditions due to the tenants (such as food and crumbs everywhere). I am a landlord. It is his job in every other case. Besides... even if the infestation is due to you guys being slobs, if it isnt stated in the contract that that particular instance would be your responsibility, then it is the landlords in every case. To be sure, get the state's landlord/tenant laws which you can probably find online for free.
YES! They are required by law to do so. As a landlord they are required to maintain the rental property. If they refuse to do so you cam contact your local police department, make a report of the infraction, and then have them help you find your local landlord-tenant court services.
I agree the landlord should be the one paying
I would think it would be up to the landlord, but I also don't know what your rental rules are there.
Maybe you could ask again. good luck. bettyk
The landlord is responsible for the extermination charge-at least they are in the area where I live. This is a part of upkeep and maintenance of his property.
Ask the Realtor in your area for regional rental responsibilities. If the land lord refuses to remove the bugs, catch them and send them to him in a half opened bag,
Yes, the landlord should pay. But, there is nothing saying he has to, unless it is in the lease.
your question has an answer hidden in it you keep your room very clean but do your room mates also keep there rooms clean infestation comes from everywhere/every one how long have your room mates be living there. If you were the owner would you want to pay for you sloppy tenants. I have been a landlord. I tell it like this. I'll pay for the problem but I want access to the home for routine inspections if you are keeping home clean then it was my fault but if your room mates are slobs you will get the bill. simple.
