Where gardens are joined but have partitioning fencing which tenant owns which side?
Question:in a row of terraced houses where the back gardens are also joined but have partioning fences if one of these fences needs repairing or replacing is the occupant of the house on the left or right responsible for the costs of the fence seperating their gardens
Answers:
When houses are built there is a piece of wire placed to divide the gardens. If you are lucky you should be able to find it or one of the posts with the screws for it. The wire shows the exact dividing point, hence, if it is on your side of a fence - the fence is your neighbour's
Generally speaking, it tends to be the left fence and the end fence on a garden belong to the house.
the posts are usually on the owners side
When you walk out of the rear of your house the fence to your left is your responsability.
Yep its left side.
I heard once that you are responsible for the left hand side..But I'm not 100% sure, sorry
The answer is to check your property deeds .
what ever is on the left of your property is down to you to repair i.e fence but if you are not happy or indoubt with the answers you have got ask your local council
i just had a problem and planning told me i am responsible for Right hand side as you look down garden
It varies from county to county, but if the house is your own and not rented, it will state clearly on the deeds which perimeter fences you are responsible for.
It might be the left it used to be only I was told that most now are party fences you would have to check it out with your local council.
There's no fixed rule. The deeds might help - fences for which you are responsible are usually shown with an inward T mark on deed plans. If the deeds say the fences are party, that's a bit of a cop-out, because neither party can force the other to contribute to repairs. To confuse matters further, whatever the deeds say, one neighbour or the other may in later years replace a fence at their sole expense, and naturally regard it as theirs after that. So, if repairs are needed, a diplomatic approach to next door is the first thing to try, so see what they think about ownership and contributions towards the cost..
With your back to the house ,The left hand side is yours
If you have the crap side of the fence. then its your neighbours lot...
Best to check your property deeds at land registry. My fence is to the right as I look down the garden from the house.
you will get many argumentive answers, the only way to know for sure is to look through your deeds. At one time the fence posts were on the owners side, but panel fences have the posts in line with the panels so that is a loser. Go to whoever holds your deeds and ask to see them, take a photocopy to avoid war with neighbours. Make an appointment first.
