Ok i moved in 5 months ago with a 2,000 deposit, well last month i couldnt pay my rent so she said its OK, She will work it out with me I thougt thats great, then one day my air condition was leaking and damaged my carpet well she was on vaction, I spoke to her son he got a Tech for me but the tech was taking forever to come and fix this problem well i was waiting, it was still leaking water, damagin my carpet and downstairs, well days later the Tech came down and said theres nothing they can do until the talk to my landlord and to dont worry they will call her asap, soo i waited now its 2 days later and no call from either landlady or tech, I called the landlady and she know nothing about this, now she blameing me for all this mess and telling me i have to move out..I dont think thats fair I tryed my best and Its not my fault the tech didnt do her job, What do i do Do you think this is fair, I can take her to court for this

1st:You are right it is not fair to you first of all the landlords son is so irresponsible that he did not handle this problem in a better fashion than he did,perhaps the problem is with the landlord and there son and not you.
2nd:the damage to the property is the landlords problem not yours it is not your fault they took there time handling the matter after all it is her property not yours.
3rd yes you could go to court over the matter but you should plan on moving out also because going to court will make this a very uncomfortable situation.
4th anyone who owns a rental property should have a reliable person or company to maintain there property while they are away on vac. etc.


i would check in with your county courts website or call the clerk, first of all she has to give 30 days of notice anyway. but hell no thats not fair and its not your fault!
You can go to small claims court. She's after your deposit to cover the damage. But, I wouldn't be too optimistic about winning. Your case sounds like it might be tough to win, even though you did nothing wrong. Might be worth a try though. It doesn't cost that much to go to small claims court.
yeah you can take her and her son and the tech to court, its the landlords responsibility to make sure that when she rents out a place that all the appliances work, providing that the A/C was hers to begin with right and not one that you purchased on your own!! but sorry to say that when you first noticed that it was leaking you should have shut if off and not turned it on until she new that there was a problem with it and had a tech come look at it, that one ? that the judge will ask you for sure, cuz if you stil left it on then that would be bad on your part sorry to say. and as far as kicking you out yeah she can do it or you can see if she will use your deposit to fix the problem and then you would need to give her a enw depoist when you can
