My neighbour has dug out his garden to the boundary-my fence is collapsing- Must I replace and pay for it?


Question:I live on a hill. The boundary fence in question has been undermined by two gardens 'below me' which have been 'dug out' right to the edge to a depth of about 3 to 4 feet. The fence is leaning and will no doubt collapse into their gardens soon. The fence is my responsibility but am I responsible for renewing it in the circumstances? Please help. Many thanks.

It really depends on the laws in which ever state, county, city you live. Where I live... if a fence is on the property line, both parties are responsible.


wouldnt of thought so. it was their actions that caused it so why should you be out of pocket?! consult a solicitor, you can usually get the first hour free and see if you can take em to the small claims court.

I would take some pictures.and call a lawyer. I really don't know what the legal situation would be,but my guess is if he's making it collapse he is responsible for it.

Yous should pay for half of the cost, but this time make a better fence, with foundations
I would think it would be your neighbors responsibility to fix it and not your own since it was his digging and his garden that is making it collapse. Darn neighbors!
If they didn't touch anything on your property you have to fix it yourself. They have the right to do whatever they chose with their yard. Good Luck!

Did he dig on your property, like under the fence? My husband had bought a house to fix up and it had a fence. The guy that was working on the house next door dug up his back yard but dug kind of under our fence causing problems with the fence. My husband filed a suit in court and had to go to arbitration but he did get some money for damages.
Have a talk with your neighbour ,to see if he will put it right ,if he refuses to put it right seek professional advice .
As their actions have caused the damage they are responsible for putting it right .If u live in uk contact the citizens Advice Bureau they will tell u exactly where u stand and be able to advise on the best way to proceed .Good Luck
Oh dear, they need to put up a retaining wall. If you cannot agree on the work to be done then you must take them to the small claims court.
asyou look at your house anything on the right side is yours, the rest is just a matter of comunication with your nabour
leave it to fall on the digger and then have a good laugh as you hand him a bill.
The neighbor has a responsibility to dig in a manner as not to cause damage to an adjoining property. Before approaching neighbor , do your research. Either by paying a lawyer for a letter of opinion, or research on the internet. Knowledge is confidence!
