Repair company is making us choose, the work or the tv?!?!?
Question:We hired a restoration company that was referred to us by my insurance company. At the beginning of their repairs they damaged our flat screen TV that we have mounted on a wall. Today I was told that they WILL pay for the tv and accept liability, but if I want them to pay for it they won't finish my repairs! I had flood damage and they've already done all the mitigation work, but haven't started to put things back how they were (including the drywall). I don't know what to do! Can they do this?!?!? Make me choose between them paying for the TV they damaged or finishing the work they started? What would you do? What should I do!
Answers:
sounds fishy to me - I don't think they can make you make that choice - talk to your insurance co - maybe check with BBB or a consumer advocate - do you know any lawyers?
Explain the situation to the insurance company, let them fix the tv and don't pay them, see if they take you to court. They will lose if they damaged your property and break the contractual agreement for your flood damage.
Have them finish the job, and when they give you the bill, deduct the cost to repair your TV. If they fight you, hire a lawyer.
First I'd talk to a lawyer and see if they can legally do this. If it's legal, then I'd take the money to replace the tv and hire another company to finish the job, paying them only for the work performed. I wouldn't want those people in my house any longer.
Review your contract with this company. One event was caused by the other.
If you hired them to repair water damage and in the process of completing those repairs, they damaged your personal property, they are liable and should cover all related costs, AND finish the repairs you originally hired them to do.
You have a small court claims case if they don't agree to complete the repairs you initially hired them to do. Contact your insurance adjuster and let him/her know what is happening. Maybe they can lean on them to make this right for you.
Good luck.
Do you have some type of proof that they damaged it? If so, let them finish the work then take them to small claims court on the TV... but the fact they are acting this way would make me wonder what other shoddy practices they'll pull on you. Do you have someone in the insurance company (your adjuster?) you can complain to and have them call the contractor and threaten to pull them off of their referral list?
they can't do this. they have insurance and are trying to bully you into skipping out on their responsibility. Turn it over to your home owners insurance and let them fight the crooks. once they're out of there file a complaint with your atterny general and the better business bureu
You probably have renters or homeowners insurance, make a claim to them for the TV and let them fight with the construction company.
