Can my neighbough saw off my sill at the side of my conservatory to build a wall for their extention.?


Question:They want to saw my sill of my conservatory although it is on my land and built by a proper builder. It is too small for planning permission but is this classed as criminal damage if they do this. It is also on my side of the fence and boundry.

I'm not sure I understand your question completely but If your conservatory is definitely and provably on your property (with a plat of survey for example), they cannot do anything to. Actually, they would need to show that it's on their property. And yes, it would be criminal for them to do so.


Nothing is too small for bylaws in a city!! I would read online about bylaws of him building practically onto your property...his trees cant hang over your property so why should his building be able to?? Dont given him an inch!!
If they touch it...sue them. Criminal trespass, destruction of private property, encroachment and whatever else you can think of.
If it is definitely on your property then they cant touch it. Its flat out against the law to destroy other peoples property without permission. If they do it, have them arrested and then sue them for the cost of the repair.
I recommend to take pictures of the area in question (especially the sill), date them, and save them in case you have to take em to court.
