UK Councils?
Question:Bit of a query that I'm hoping someone can help with...
Outside my house and on council land are 3 massive oak trees. These trees haven't been trimmed in years and are now effecting my phone line that runs through them. They've even caused damage where they have pulled the phone line away from my house. To make matters worse they've now grown so high I've completely lost my Sky Sattelite TV reception too.
With their roots my front path has become cracked and raised in places, although this had happened before I moved into the house.
Have the council got a duty to trim them?
Can I claim for the damage to my house where the phone lines pulled a fascia board away?
Can I claim for the £40 a month I'm paying for Sky?
Have I got any come back on them sorting out my path?
Sensible answers only please
Answers:
ok what area are you in UK wise and what council are you dealing with....some areas are easier to get things done than others
BEST bet regardless of what council you come under, go down to your local office and ask for the name and address and contact number of the local council man / women that covers your ADDRESS...they will have this info to hand.
Secondly put everything in writing and send it in REGISTERED post...KEEP copies of everything you send and I would not put a phone number on the letter but IF you do when they contact you request that the conversation is folowed up in writing.
Most councils have a web site address as well.
and rather than waffle on about not getting sky reception I would point out that as these trees APPEAR to be on public ground and as such they are liable you would hate for them to be sued by falling limbs in the near future...and that as a copy of said letter IS being kept in your files they would NOT be able to plead innoccence to the problem at a later date when getting sued. The path SHOULD be covered by them.
Is this a private house or a council rented / purchase.
If you wish please go to my page and send off an email as whilst I am in the USA am a Brit who's dad is in local government [lol lol yeah I know] so might be able to get you more detailed info once I know what area you are in.
