Part of my large tree fell into neighbors yard and they called city inspector who told the landlord they have?
Question:7 days to move the tree but due to fact it fell in that yard the landlord said he is not responsible, what will happen since they wont remove the tree?
Answers:
If the tree may contribute to or possibly cause additional damage in its current state, your neighbors insurance company should come out and do what is necessary to avert any additional problems. They will then sue (they do not need your neighbor's permission) your landlord's insurance company for the cost of doing the repair. This area of the law is still murkey because people have been going to court over trimming trees, roots, etc. and for the related cost of cleaning up after the tree and for any damage done by the tree. Unfortunately different judges make different decisions based on individual circumstances as they see fit. My advice is to have your neighbor call their insurance company and let them deal with it. This shouldn't involve you at all.
The city will remove it and send a bill to your landlord.
citation and fines.
If you own the property your tree is your responsibility - if not by your local law then at least morally. The tree is on your property and you are supposed to be sure that there are no limbs that are dead or that pose a hazzard.
If you are renting your property, your landlord is responsible.
Our neighbor's tree was struck by lightening this weekend and has to be removed, so I know that this is not a cheap thing to do.
The owner of the neighboring property could sue you (or your landlord if you are renting) for any and all damage done to his property and for any costs of removal if he wants to.
Call your home owner's insurance if you are the property owner. If you rent, stay out of this totally and refer any questions to your landlord.
Well last time someone told me if anyones tree of bush (or anything really) falls into a neigbours garden the neighbour has to give it you back so just get the part of the tree and take it to the tip or somewhere
