My neighbor has a very tall pine tree with limbs hanging over my side of the property line...?


Question:I want to have them cut back but you would have to enter his property to access the trees. What are my laws for entering his property to access the tree in order to have the limbs cut?

By law you can cut them back from your side of the boundry line up to the boundry, in regards to entering his or her property to do so i believe is illegal, BUT... you could always ask them, most people will be reasonable enough to allow you to tidy it up a little. If that option doesn't work, it would become a problem, you'd have to get legal advice on it. I'm not a qualified solicator so i can't say how that would go. But my advice would be just cut it back as best you can from your side, or talk to them. Also, forgot to mention, as some others have said, you do have to offer to give the branches back lol, strange but true. Best of luck mate


You can't enter his property without permission, but you can trim the branches that overhang yours. You must give the trimmed branches back to your neighbour, if you don't it is theft.

You can only trim the part of the branch that is over your property. I would waait until after midnight to trim in case he has a shotgun or something.

I would imagine you would have to ask him, but if you can cut the branches from your side then throw them back. That way you can't get in trouble for taking his property!!

Why don't you just ask him? Maybe you can each pay half to get the tree cut down? Just be neighborly and maybe he can cut you some slack line.
There have been loads of questions like this and everyone will tell you that you have the right to cut back anything that overhangs your property. You are then required by law to offer the prunings to the owner of the tree - don't just throw them over the fence. You have no rights to enter his property nor cut back anything on his side so don't even think about that.

Given that this is a conifer it is highly unlikely that the tree will have a protection order on it but check anyway. Anyone cutting back a TPO tree is committing a criminal offence.
why don't you just ask him if you can go round to cut them?
You can only cut what overhangs your garden and you can ask if he wants the branches back as they are legally his. I'd ask him if you can go round he can only say no, if he does then just throw what you cut off into his garden. Good luck.
I'm assuming that you are friendly with your neighbour. Ask them round for coffee some weekend, and in the middle of the get-to mention the trees, it is possible that they are unaware of your predicament.
If the tree is leylandia then the rules are different. A leylandia is not allowed within 10 metres from a house because the roots get under the building.
