Help!!!!?
Question:I stay in a condominium and have a massave spruce tree dumping say and black stuff on my deck, at leat over a 1/3 is unusable because it is black and sticky. the association has declined to do anything do to "cash".1 trustee said I have a car being damaged by a tree and the other said so is my deck being damaged to u have to accept it. Can I hold these trustees liabile for these comments and what legal right do i have in this regard. the trustees have a fiduciary duty correct? Cash or no cash. can i expect them to repair my deck? Is there an organisation in Canada I can approach.

I'd have to agree with Wheeza (above), save yourself the fight, rent a pressure washer maybe $30-$40 dollars for a day, every springtime. Your deck will look new again. Home Depot has deck cleaning soap to help get it off quite easily. Hope this was helpful ;-)
Like they said you have to accept it.I think the idea Steve is to clean your deck now and then.You can't blame the tree.
WHAT DOES YOUR CONTRACT SAY? WHO IS RESPONSIBLE FOR YARD AND LAWN CARE. AND TO WHAT EXTENT CAN YOU THE OWNER TAKE CARE OF SUCH NUISANCES. I THINK THAT IF I HAD TO PICK BETWEEN THE COST OF A NEW DECK AND CUTTING THE SHRUB, I'D CUT THE SHRUB. IF THEY COMPLAIN MAKE SURE YOU TAKE PICTURES OF YOUR DECK WITH THE DAMAGE DONE BEFORE YOU CUT. TRY GETTING SOME DECK CLEANER FROM HOME DEPOT OR LOWES OR YOUR LOCAL STORE. TRY AND CLEAN IT FIRST. GOOD LUCK.
Depending on the particular rules pertaining to your condo, you could hire someone with experience to trim the tree so that it does not hang over your side. As for your deck.. were you aware of the tree when you moved in?
I'd find a way to remove the tree.
Yep I'd sue or just order up a guy to saw it to pieces.
End of problem.
They can't force you to have to live with tree sap on your deck.
Or sell it to someone they would not like.
