My neighbours hedge has pushed over my fence, can i get them to replace or pay for it?
Question:The fence is mine and the hedge is the neighbours, the hedge is planted parallel right against the fence, as it has grown into the fence and pushed it right over.

Technically they do have a liability here. If your neighbour or your neighbours property damages you or your property (when he could have taken reasonable steps to avoid it) then he is liable. A simple analogy is that if a branch from one of his trees fell on your roof or your greenhouse, he would be liable. Likewise his hedge damaged your property so technically he is liable.
You might want to note that in Law if the hedge grows on your side you are legally allowed to cut the bit on your side, although you must return the cuttings to him as they are legally his property.
Next time though I would just ask him to cut the hedge before it gets to that point.
why not just chat to your neightbour.

Why not get yerself a chain saw and cut the thing down, then you can have a nice chat over a cup of tea OVER the fence.
if its pushed over ure entitled to ge trid of it after telling them to do so ..so if they dont do it ure allwoed to trim or remove it cuz its on ure side.
Technically by pushing your fence over, his hedge is now on your property. You should be able to get him to replace it, or at best, cut it back
if the boundary rights are yours, then it is down to you for the upkeep of the fence, since your neighbours hedge has damaged it, speak to them first, as good neighbours can make a happy homelife. if they refuse to repair or replace and you can prove their hedge damaged it, you can always threaten a small claims court order!!

I would get them to look at it and ask them to replace it, they should have been maintaining the hedge to avoid this happening.if they are not interested speak to citizens advice!
Yes you can, have a word with your neighbour first to make sure it is their fence. If you have understanding neighbours they should replace it. If their hedge encroaches on your property, you can cut back whatever is on your side (as long as you give the cuttings back to them).

It is the neighbor's responsibility to repair the damage. However, it would help should it come to a legal issue, if you have complained to them prior to this about the hedge. Make sure you take pics before any repair is done and keep records of any conversations about it.
If the fence is yours and their hedge has caused damage to your fence they should replace it. Odds are they wont want to pony up the money unless you push a law suit..Are you 100% sure the hedge has pushed the fence over and its just not fallen due to the age of the fence I dont know of any bush that is so strong it will knock over a fence. I have hedges/bushs along my fence on my property as well as my neighbor has them planted in his yard along my fence on the property line and we dont have this problem
