Depends very much on where you are, and why you want to evict. In California, the process normally takes about three weeks if the eviction is for non-payment of rent:
- Serve a 3-day notice to Pay Rent or Quit.
- If no response, go to the courthouse and file an Unlawful Detainer lawsuit. (Get the forms ahead of time and have them filled out, ready to go.) Have the Summons and Complaint served by a process server or some other disinterested party.
- After five days, see if an Answer has been filed to your complaint. If not, file for Judgment by Default. This will take a few days to get. (If an Answer has been filed, there will have to be a trial; file a Request for Setting.)
- Take your Judgment, and Writ of Execution, to the sheriff's office. The sheriff's people will physically remove the tenants from the premises. Be there with a new lock.
well, present them with the reasons why this is happening, but i wouldn't be too kind, cause they make take advantage of you, and that will cost you money in the long run, so present them with the reasons in an open discussion, and once your completed with your conversation, hand them the pink slip and tell them unfortunately, this is the way it is.
It all depends where you live. I live in the south and a friend of mine had some apartments where a family moved into one without renting it. They wound up having more rights than my friend.
