I want to waterproof and stain my patio deck can I do this without sanding?

You can, but the fact is, you'll probably be redoing the sealing within 2-3 years depending on the amount of sun it gets, the rain you have, basically the elements. If you use a good 150 grit and a floor sander, you can get a good even stain on it and the sealer will look good and adhere well. The better the UV protection on the sealer, the longer it will last. I've used Thompsons on a deck and a wooden bench and they lasted 7 years before I figured it was time to do it again.
We recently waterproofed and stained our deck. It is not a MUST to sand it down first, but it is recomended. A good (and cheaper) alternative is to power wash your deck (that is what we did). Power washing will help you clean the wood wery well and find any rotten planks that you must replace before staining and sealing it.
We own a power washer, if you can't afford to buy one (they can run pricey sometimes) They rent them out in places like Lowes and Home Depot.
