What can I legally do about my neighbor's tree?
Question:My neighbor's tree which is between both houses, but on his property, now has several large limbs hanging over my house and my driveway. I'm concerned that the limbs or even the whole tree could fall on my roof should we be hit by a hurricane this year. I've been after him the last few years to trim or even remove the tree. Just this past weekend, he trimmed the side of the tree that was hanging over his house, but did nothing to the tree on my side. Can I trim the limbs or any of the tree on my side? If I can, can I send him the bill? Can I make him at least split the cost?

yes it is your responsibilty, if it is on your side of the proptery line, no you cant split the cost, you just need to manage your side of the tree, or call code compliance in your area, they probily can help you too.
Try to work it out with him, ask him if he wants you to cut your side of the tree, I remember when I was a kid I was planning on building a tree house in a tree and our neighbor illegally got it cut down. (It was in the middle of the houses like the one you described)
Yes you can trim anything that hangs on your side of the property.I don't thing that you can charge him for it .Sounds like you don't get along with your neighbor as it is so I would just do the trimming and leave it at that.
Legally I think that you are responsible for cutting the tree limbs over on you. Since his property the tree has limbs hanging over into your yard or over your house [your property]
and if damage is done to your property from his property then you could make him pay.
Ask your neighbor if he will have the limbs trimmed and if he says no then you will have to do it or have it done.. He can't legally until he has permission from you. If the tree is on the line, legally he cannot trim or cut the tree without asking you and you can't without asking him.
