Access passage between dwellings.?
Question:I need a lawyer! I live in a terrace house with a 3 metre passage between mine and my neighbours (rented) property. Vandals regularly shelter in this passage and really enjoy daubing graffiti on the wall on my side of the passage. The passage is owned and 'maintained' by my neighbours landlord, unfortunately, the affected wall is mine. Myself and 2 neighbouring families have legal access through this passage.
I've asked the landlord to erect a security gate to prevent this damage from happening and also to secure the rears of our properties from burglars. He, of course refused. He lives in a mansion 10 miles away. Is there any legislation whereby he is obliged to provide more security for the 3 other dwellings at risk? Are you, or do you know a legal eagle who can give me sound advice? Thanks in advance.

If the passage is narrow (you didn't state if measurement was length or width) you could all get together to buy a wooden gate which could be fixed onto one wall. It could be padlocked and each of you could have a key for access. Another idea is to have a security light fitted inside the passage. Sorry you are suffering this problem.
no he do'es not have to do it , but if you all got together you can put up a steel gate with no acess and each have a key and keep one for your landlord
Every property deed should have an express covenant for the owner 'not to cause nuisance'.
In plain English it means that every owner has an obligation not to cause or create a private nuisance to neighbours by way of noise, material injury to property, personal discomfort etc.
Everyone is entitled to 'quiet enjoyment' of their premises. The occupant of the property affected by the nuisance is the person who should bring an action to sue and an award for compensation can be granted.
Go to Citizens Advice to get some free advice but go to a solicitor to send a threatening letter to the neighbour.
Why not put a gate at the entrance of the passage

I would call the housing authorities on your land load.
don't bother with a lawyer it will be much cheaper for all 3 of you to club toghether to buy a gate , security is not an issue when renting out a property only health and saftey.

go to the CAB they get a lot of this kind of complaint i think they will be able to steer you to the right person
