I have a crazy neighbor who built a fence on our property, am I within my rights to take it down?

I can see this case going to court one way or the other.

1. Make sure his fence is really within your property line, if so talk to your police or sheriff department and try to lay charges for trespassing and erecting a fence without your permission on your land. He will be forced to take it down.

2. You are technically entitled to tear down his fence if it is on your land, he then might come with a gun and blow you away, since you mentioned he is crazy.

3. He might try to sue you for destroying his fence even if it is on your land, he'll never win the case, but you're pouring good money down the drain for lawyers.

So play it safe, don't overreact, know you r rights and talk to the cops first.

Keep in mind, idiots like these never give up and be prepared for a tit-for-tat game to follow.

Yes, but before you do, go to your township building and get the correct property size of your lot (just to be sure) so you can show him that he's over his line. Have you tried asking him to take it down?

Not only do you want to have a survey done do be sure it is on your property. You also should check with your city or county to be sure you don't need a permit to remove a fence. Some cities are very controlling.

Chances are your neighbour is going to be unhappy so he will look for any way to cause you trouble. If you do work without a permit you can bet he will be the first to turn you in.
You have the rights to ask them to take it down but if they don't, say that it is on your property so you request that it be taken down.
If it's on YOUR property, then they didn't have the right to put it there in the first place.

I'm willing to bet you've already tried to talk to the neighbor, and apparently they've got their own understanding of where the property lines are. It is within your rights to remove the fence as long as you own the property it's on.

You may need to hire a surveyor; he'll research the deed records for each property and tell you EXACLTY where the neighbor's property ends and yours begins. That way, if things get ugly with the crazy neighbor, you'll have the survey as evidence that you were within your rights.
Check with the city first and then get a sledgehammer. If it is actually on your property - go for it. I don't see why it bothers you though. It gives you more privacy from your "crazy neighbor". I wish my crazy neighbors would put one up... Save me the money and time. Good luck.

I built mine, and one of my neighbors has chain link. My contractor just left a walking gap between the fences, which I have to trim off often.

I have been here two years, and never had a problem with my neighbors. I just ensure the grass goes not overgrow and annoys them
Why do you want the fence removed? If it is behind your wooden fence it makes no sense that you want their fence removed .. or are you one of those crazy neighbors?
