A neighbour has planted a large hedge round his property which is open plan what can we do to get it removed?
Question:The hedge has grown out of control and looks a mess it must be about 10 feet high at the moment and still growing. Part of it goes down the side of my drive and I have to cut it back but I'm finding it very hard. It is residential property and privately owned. It states in the deeds that no hedges or walls can be built.

There are always problems of this nature on so called "open plan" estates. Before you pursue the deed covenants, check with the planning department to see if they placed a condition relating to hedges on the original planning permission for the estate. Its a long shot but this did occur in the sixties through to the early nineties in some areas. If you are lucky you can simply report it to the Council enforcement section and they should investigate for free. If not then you will have to get some legal advice from your solicitor.

Call the city inspectors and find out if they have a 'variance' and were permitted to plant the hedges.

some hedge plants have been band due to the subsidance they cause to property mainly houses and garages if it is then get straight on to the council and they will send a surveyor but even if it isnt they still have the right to order it chopped down
I would first ask him to take it out. Show him the paper you have and be nice. You have to live next to him. Hopefully he will agree. If it really bothers you... then you might be starting a war. Is it really worth it???
You probably have to contact your city, for example in my city before you put a fence you need a permit from the city. I would contact those people. Get local directory out. That however would be my last resort.

You can only consult a lawyer to see if all the properties on your development have a similar covenant or restriction in their deeds. If your neighbour is infringing these then action can be taken to rectify the situation. It might mean a court order to remove the offending trees.If he does not comply he can be imprisoned for contempt of court.
Covenants in deeds are almost impossible to enforce. Just keep cutting
Just spray a little amount of Round-up ,in the part that is in your property of course and wait a few days
There is an acid based chemical available in garden centres. Mix in a watering can and spray on, it goes down to the root ( systemic ) and kills the tree,. Make sure you are not seen.
