Can your neighbor cut off branches from his tree and drop them on your side of the fence?


Question:My neighbor just cut branches off of HIS apple tree (next to the fence) that divides our property and dropped them into my yard. What can I do? I don't feel that is okay or that I should have to clean up the mess. I already pick up apples that fall off into my yard and throw them away. I have to pay to have the branches removed and only after I cut them up small enough.It is not an option to talk to them they don't care.

No. The law here in Australia is that you can pick up all the branches and apples that have fallen on your side of the fence and put them back over the fence and your neighbour can't say a thing to you about doing it. The same goes when you prune a branch or shrub of the neighbours, where the branches are coming well over to your side, you can cut them back to the fence line and put the cut branches back into his yard. well first i would talk to the naighbor then put up some private property sighns then if he persits you could repeat Could sue him or just toss them back over the fence
Sure he can do so if, he is a jerk! Try talking, if it doesn't help call law enforcement. Maybe he/she needs to get the message from someone of authority. As a final step try small claims court.

I think it was very rude for your neighbor to do that. He has the right to cut the branches but he should be responsible for cleaning up the mess, not you! Maybe you should print this and drop it in his mail-box!
Your property is your property and he has no jurisdiction or right to do anything on it or to it.
You are allowed to cut branches from his tree that extend over your own property, but then would be responsible for their removal, for your property extends "heaven high and hell deep." What he did is not legal.
I am perplexed with his mind-set. Have you asked what he was thinking?
The part of the apple tree that hangs over the fence becomes the property of the non-owner of the tree. The reason being that one owns his property from the ground to the sky. So, start removing the apples and branches because they belong to you! Jaye
