Neighbours extension?
Question:I live in a terraced house which at the back forms an L shape so does next door. They are going to fill in their L. In doing that they will blocking out my only kitchen window as their new extension will b only 211cms from my house and it is going to b 3.7metres high. They have permitted development and have got building regulations but no planning permission as they say they dont need. Can this be true or do i need to go to council and see if they need planning permission too.They have been very secretive so far and did not serve party wall notice on me which they knew about. they have had to do that now but i now dont trust them and wonder what else they may be trying to get away with.

Sadly all the idiots come out of the woodwork when someone asks a question like this. Questioners deserve a qualified answer rather than barrack room lawyers spouting off about things they do not understand.
You say they have permitted development (rights) and this is probably the case. A terraced house can be extended, subject to certain siting and height restrictions, by up to 50 cubic metres without the need for planning permission. You also say that they have Building Regulations approval so this does support the contention that they are ok to proceed - this is because when they submitted that application then it would have been checked against planning rules.
I obviously dont know all the facts but I doubt that what they are doing would require any action in terms of the Party Wall Act.

i would surmise that they do need planning permission,i know you don't necessarily need it for conservatory's,but as for a full blown extension then to my reckoning yes they do need it? if they go ahead with the build and they haven't got it the planning department will make them take it back down again?
If any part of the construction interferes with your natural light - you can stop the work - they will need planning permission for this - talk to the local planning offices FIRST thing in the morning
Contact the planning department as they are not allowed to block your light so they probably do need planning permission.
Phone your local council in the morning, and ask to speak to the planning department. It can vary slightly from district to district but my understanding is if they block your light you may be able to block it. However if someone else has an extension it will set a precident.

It is true that they do not need planning permission for an extension, providing that it is of a certain size. If building the extension will affect the position of the drains, manholes, etc. then they will need it. Since almost all kitchen extensions require the movement of a manhole, they may be trying to slip that through unnoticed and then, some time later they could apply for and get retroactive planning permission. It's worth looking into. Also, any build over two metres high that adjoins a road or another dwelling, needs planning permission. You should make your local planning department your first port of call as they will provide you with information to support your objection, whether it be loss of view/light, the effect on your access to a common sewer or drain or any other legitimate reason for your objection.
