What is the law on overhanging trees and bushes into the shared alley between two back gardens?
Question:
Answers:
if overgrown greenery is interfering with your use of the property, you are within your rights to responsibly cut back the offending plants. You are also responsible to do it in such a way that does not cause trauma (kill) the plants
As for throwing them back onto someone elses property.properly dispose of the stuff..it's against the law to throw anything onto someone elses property
Well you would actually have to find out your boundries as to your deeds of the house. If the trees overhang over your boudry line, then you are well within your rights to cut them back and throw any cuttings back into the property where the tree grows.
Call your local Zoning Dept. & they can help you in that respect.
For us in New England we can cut anything hanging over ontoour yard - wether a branch or vine or what not :)
If it's a real problem why not just ask the owner of the tree if they will cut it back or if they mind you doing it
In my neighborhood, trees must be trimmed at least 8 feet above the sidewalk. Tree branches or vines hanging over your property are your property. It is legal to trim the portion that grows over the property line. Do this within reason. As for a shared alley, I suppose it depends on who owns what. If the city owns the alley lane then they should be responsible to keep it cleared. You may have to contact them to do the cutting.
