Assuming you live inside a large city that is zoned residential you can cut down any tree you want to EXCEPT if it is a street that is known for it's oak trees and there is a by law against cutting them down to preserve the character of the neighborhood.
But the answer in all cases is you have to have the by law come around and tell you which way is safe to do it, have professionals come, submit a plan and then have it cut down so it doesn't damage something.
But since it is an oak tree, and only six years old, it can't be much bigger than a sapling. You could dig it up so it doesn't damage your foundation, replant it and it would add to your property value. To do it so it lives, you might have to have professionals do it.
Regardless call your city government and ask. That much you have to do before doing anything outside. Even if you dig a hole you have to call to make sure you won't cut into the phone or gas lines.
