I have a neighbor threatening me about trimming limbs on my tree that is hanging over her yard.?
Question:Do I have any rights in this?
Answers:
Your neighbor has the right to trim limbs (himself)that overhang his property, BUT he has NO RIGHT to force you to do anything.
its youre tree do what you want with it
its your tree, do whatever you want. they have no right.
I believe that if your tree is hanging into her yard, those limbs belong to her. Trim them up the way you want and you won't have problems.
if it becomes a nuesnece then yes,,, keep the tree on your property,, and stop his whining.
they can trim what is hanging over into their yard legally.
Call your local City Hall & they will tell you who to ask specifically.
You're allowed to do that. Anything extending over to her property is hers. She can't take the tree down but it's perfectly legal for her to cut what extends over her property.
Nope.
You have to cut them, or risk her suing you. And she will win, because your tree can't infringe on her property.
<edit>
these answerers who said it's your tree, do what you want, have they never watched Judge Judy?
It's not HER responsibility to cut them, if the trunk of the tree is in your yard, YOU have to cut them if she complains. It's the law.... you can call a lawyer and they will tell you the same thing.
Limbs hanging from your tree into the neighbors yard is not your problem. They should trim on their side.
Your neighbor can cut limbs overhanging his property. You can check with your local authorities about the legalities.
Not really. You could have an inspector come out to see if the limbs pose a threat to her property but for the most part if it is her property and she doesn't want the trees hanging over it than she has every right to ask you to cut them back. Also it is less expensive to have trees trimmed than face a hefty fine or lawsuit if one of the limbs actually cause damage to her property. Depending on your locale she could even report it to your township and make things miserable.
Depends on the laws where you live. Here if the tree is on your property but the limbs hang over onto someone else's property that person has every right to trim the limbs as long as they do not kill or harm the tree in any way.
You couldn't build something that had any part of it on your neighbors land, just the same, you can't have something on your property that invades the property of your neighbor including airspace. If your tree has branches that are hanging over into your neighbors airspace then you are most likely in violation of your local laws and will be required to trim the tree, especially if your tree sheds leaves or sticks or anything onto their lawn.
You'll want to check the applicable laws on the subject but my advice is that what may ensue is what will likely be a legal procedure which you will ultimately lose. For the sake of legal fees and good faith among neighbors I'd advise trimming the offending branches.
If there is a property line...the part of your tree that hangs over her property is hers......If it were an apple tree the fruit that fell from it into her yard would be hers..So simple to solve....talk it out and see why she is upset for you trimming your tree,? Surely you would not cut the limbs and leave them in HER yard...God Bless
If your tree limbs are in her yard she can cut them back to your property line.
It's your tree. It's your responsibility. Trim the tree or be sued. it really is that simple. Trim the tree now or be forced to trim the tree and pay legal fees. Sorry I can't give you a better answer but that is the way it works. I really wouldn't listen to those saying do nothing they will just bring you more trouble. One last thought , being a good neighbor sometimes means putting up with bad neighbors.
You have the right to trim the limbs yourself... but aside from that, if they're over her property then she has the right to trim them back.
Noo you ARE NOT OBLIGATED to have to trim them...the person on the other property has the right to if she/he wants too..but cannot force you to trim them..he can only trim what hangs on his side, and cannot get into the tree or come on your property to do so without your permission first..now here is a neat catch. If they get real threatening, and eventually trim them, and do not give you the chance to have the cuttings and haul them away without your consent...You can actually file theft charges on them..they can trim..but the wood/limbs are yours. Now another thing...if the limbs are damaging his property as far as leaning on his fence harming it, rubbing against thier house etc..they can make you liable for that damage..but if simply leaning over the property..it is own them...Now if i have read this wrong...and they are threatening for THEM to trim the trees on thier side , and not you..they have every right to.this link below has laws on this as well
