Who is responsible for fallen tree?


Question:I have a huge tree in my backyard. It has started decaying and cracking at the very bottom. I am afraid it might fall on my neighbor's property. I am doing by best to get a professional tree cutting company to get the tree cut, but either their prices are way too high ($4000+) or they don't show up. In case if it falls then I want to know who will bear the responsibility. Thanks.

it's the land owners responsibility where the tree is growing. not many people will take their life in their hands to remove a decaying and cracking tree. if you find one that well do it and do it safetly, then you are going to pay for it. you will be paying as much for what the person knows as much as the labor. a lot of folks think just climb the tree and cut it. this is not the case, it takes a lot to be able to do this right and safely.


YOU are responsible if the tree is planted/based in your yard. By law, you are responsible for trimming it and for any damage it may do if a piece or all of it falls on someone else's property. You could be sued so be careful.

By the way, professional tree cutting services can be such rip offs. I just had to trim my tree and I called 5 different places and their prices ranged from $2,000 down to a mere $350 so don't settle. Call around and get the lowest price available.

Your homeowner's insurance should take care of it, call them and find out. That is if it falls. If you want to cut it down, you will pay big bucks, this is an art and a science. Do not give your insurance company the info you gave here, just say in the case of a tree falling in my neighbors yard am I covered?? I am not sure about lightening strikes, could be considered 'mother nature'.
The homeowner who's property the tree stands on is responsible for any damage caused by the tree. If your a renter it, would be your landlord's problem. If you are the owner..then I would cut that tree.
depends on whos property it's on and who cut it down if they had permission to cut it down than it's whoevers property it's on if there was no permission to cut it down than it's whoever cut it down
The person that owns the location where the tree is oringally planted is the repsonsible party. If the tree was to land on the other persons car, then that wouldnt fall under your homeowners or theirs, and you could be liable for the damages done to it. I know because this happend to me at my parents house.
If the tree is on your property and you own the home and not renting then sorry but you will be responsible.

If it is close to any power lines, you might call your local electric company and they may cut it down for you for nothing or next to nothing.

Your insurance coverage may cover it if it falls on your neighbor, but if you already know it is in bad shape the cost may still go to you due to it being called negligence of a known problem.
I had two oak trees and two pecan trees cut down , hauled off, and the stumps grinded for about $1,800 so I think they are charging you way to much. It was two days work. To cut and remove one tree should only take less than a day. No tree cutter here makes $4000 for less than a days work!

You will be responsible if your tree falls on your neighbors home. Now if your tree branches extend over your neighbors property and one of those branches falls and damages your neighbors property then you are NOT responsible because your neighbor has the right and responsibility to cut and remove the branches from your tree that extends over their property line. Just as they have the right to cut, remove, or take anything of yours that extends over to their properity.
