Do you have to have a fence around your yard to get a pool?
Question:
Answers:
You will want to check your local zoning requirements for that. I would definitely recommend having a fence as you will incur a tremendous amount of liability by having a pool in your backyard without adequate protection. If a child in your neighborhood were to be injured or even worse, killed, you would be opening yourself up to a problem. Not to mention, a lifetime of guilt.
Check with zoning; most places require one now.
In California you do. Contact your local City ordinance dept and check with them. I would do it anyway to reduce the possiblity of being sued.
some states might not require it, but you should check with your state laws. it would be a good idea to have a gate and lock around the pool. you don't want people walking in uninvited using it, and god forbid something bad happens. you would be liable for that person, even if you didn't know that person was there or gave permission.
What you got there with the pool is called an "attractive nuisance".
That means it's up to you to make it safe and inaccessible to anyone who may get hurt by it.
As long as you take "reasonable precautions" like a fence with lockable gate, or a ladder in the case of an above ground pool that can be raised and secured, legally you should be OK if something happens.
It depends on where you are. In Florida you not only need a fence, but a child proof cover or gate when you are installing a pool. Another thing you may take into consideration is your homeowners insurance. They may not cover you in the event someone gets injured if you neglect to take precautionary measures such as putting a fence around your pool.
