Want to build a fence around property,only city won't allow it because of a Ease Way going threw the locatoin?

You need to have the legal plat of your land, with boundaries clearly established & marked. I think you can get those at the courthouse & if you call & speak to the clerk, she can pull it & have it waiting for you when you get there, the charge is pretty small. THEN, you'll need to find out where the easeway is going, how much of your property is affected & if there is anything you can do about it. You'll have to talk to the city planning commisioner or clerk about that - they should be able to point you in the right direction, who to talk to. Tell them if they're taking your land, you want recompensation!!

Talk to a real estate lawyer. If the land is legally yours and the city is claiming it's an easement, they will need to prove it.
Easements are generally for the purpose of providing utilities to everyone in the neighborhood so they are granted to provide gas, power, phone, CATV etc. They are necessary and legal, not much you can do to avoid it, you can apply for a variance and see what happens. If you do not put the fence on top of the utilities, it may be that no one cares.
see if they will allow a gate entrance at the ease way. but I dont it.
I would speak to a lawyer. I would also speak to a city official and ask what they would suggest. They shouldn't be able to keep you from putting a fence up. The only thing is because they do have an ease way they would have to have access to that easement. If you provide the access their should be no reason to no let you put up a fence.
