Leylandii Height?
Question:Is there a new law out which governs the height that leylandi trees can grow, my neighbours leylandi are now nearly 30 feet high and block the sunlight out of our garden until about dinnertime everyday. We have asked them to cut them down but they say f*** o**. Can anyone help where we stand legally and where i go from here.

The gov introduced legislation under the Anti Social Behaviours act in 2003. It gives the local council rights to demand that a hedge over 2 metres be reduced to a 'reasonable' size.
The council will look into the complaints (for a fee, I think, to discourage frivolous complaints) and then will make a judgement. If they find in your favour, they can order the neighbour to cut the trees. If the neighbours fail, they can be prosecuted.

write to the parish and your county coucil offices first and see what they say. There might be local rulings.
Failing that, don't chop them down too noisy and less discrete, 1 litre of petrol / jeyes fluid / or similar on the base of each tree will kill them off in 6months. They will then have to remove the dead tree. Best not harass them as they will know who to blame !
12 feet is the limit. involve your council, they can intervene.
The cost of cutting the trees back is the owners responsibility.
The trouble with these trees is that they grow at 3 feet a year so its going to be a permanent problem
If they overhang your property then you can cut the offending brances back and chuck them into your neighbours garden to remove.
Check with the council though about the problem, they will come and check and inspect the site if your concerns are that great.
Otherwise, you could accidentally put some root kill down there to kill off the 'weeds' that are growing as the neighbours dont seem to be very enviromental friendly to your concerns.

You probably have no legal right to light, however it is not generally known that the roots WILL be in your property.
Dig a trench close to the boundary where you will expose the roots, SEVER the roots and pour salt and creosote if you have some.. Put back soil. Poundstretcher UK sell a chemical for killing the roots of trees. NB These trees are considered weeds and should not be planted,
The government introduced a law on this about 3 years ago. The legal height is ^ft. Get in touch with the parks department of your council and check it out. Tell them about the situation. legal height is 6 feet.
Try your local council, they could have words with them also environmental health as its blocking your light, but first to keep the peace have a word again with them saying that if it not cut down soon you shall have no alternative but to get some help from the council, as there tree are blocking the light from your home.
