Law about diverting/ chanelling water from one person's garden to another?


Question:The person in a property on a higher level with an adjacent garden is chanelling his rain water down to my garden. Is this legal?

No it is not. In many places natural run off is considered "no fault", but if he has diverted water directly onto your property, he can be held liable for correcting it and any costs of repairs due to water damage to your property. Speak to him directly first, but if he refuses to address it, then contact your local city hall to find the procedure for addressing the matter officially.

Consult a solicitor, the law has changed over the past few years and i am sure it is illegal to do this nowadays. In Scotland you can now be prosecuted for this.

surface water is your problem, its only your responsibilitie to channel it across your garden.

however sometimes if it causes a serious problem you have recourse
