Swimming pool fence laws in Tennessee?
Question:I am putting up an above ground swimming pool in middle Tennessee and I'm trying to follow regulations (already called Call before you dig, etc). What is the law regarding the height of a pool that would REQUIRE a fence to surround the area of the pool? My pool is 52" and no fence surrounds our property at all. Not sure if this is relevant or not but we live in the county and also the pool is in the back yard.

I work at bldg insp office in Ala. and ours is 4ft min. height fence around the pool with a self enclosure (gate)..Probably pretty standard. Everyone using International Building code now....Mostly....
Ordinances vary by location. It may be a state law or it could be a local ordinance. Call your town office and ask. The buildinging inspector should know.
I'm pretty sure the pool will need to be fenced but I'm not an expert...This is really an issue that comes under protecting the health and safety of people, so you could try contacting the Tennessee Dept of Health. Here's the link to their homepage, which has their contact numbers and so forth:

I'm sure they can at least direct you to the right officials to ask. Good luck!
My next door neighbors in middle Tn. had an above ground pool with no fence.
I'd also contact your home insurance company regarding additional coverage for the pool. I also tend to think that they are either going to have their own fence/lock guidelines or will refer to a state/local or national authority for the rule - I'm sure they could give you the appropriate agency info.
You want to make sure you are protected - emotionally & financially... especially in case the unthinkable happened because your pool was being used when you weren't at home.
