Can we sue them?


Question:Our street is getting repaved so they have to scrape it all up. We normally have a basketball hoop on the street so we moved it into the grass temporarily. Apparently they had a little trouble with the basketball hoop or they just didn't like it so they left a big pile of scraped up pavement on our curb where the hoop would go. Can we sue or at least have them move it.

If the "street" is really a public street, you are probably better off not saying much. It is generally illegal to have a basketball hoop on a public street. You could get a warning or a fine.

I think it depends. Is where the hoop is considered to be part of your private party or is that section owned by the city or county where you live? It it is on your property then you could have grounds to file a complaint of trespass to land since they are interfereing with your exclusive right to use that land. If it is on the part that is owned by the city or county, then I agree with the first person that you can call and ask if they can move it. Just remember that if they own it then they don't have to comply with your request. Good luck

Sue - - No. Basketball hoop not even an issue since you are talking about the gutter area. However, you CAN call the city and inform them, about the company they hired, did not remove pavement waste which is a hazard. Now the city is informed, it is their job to get on the backs of the contractor.
once they are through with th street project you can then ask it to be removed..or take a picture of it to the court house or building department and ask themm...as far as a suit..they have what is called an "easment" which is generally 6 feet from the curb into the yard...and they are allowed to do this within reason.I wouldn't mention the basketball court thing for letting your kids move private belongings on the street is actually a privledge not a right.They could actually ask you not move it onto the street when you do this, but rarely is the situation that they do unless a major feeder road etc...
