Am I contracturally obligated to roofer?
Question:Last week I signed a "Acceptance of Proposal" on having a new roof put on my home and have roofers scheduled to be at my home in two days. Stupidly I failed to get more than one quote. Now I have a better quote. Can I cancel the appt with the first roofer? Or can I call them and ask them to match the better quote? This new roofer also says that Owens Corning shingles are inferior. Is that correct?
Answers:
(NOT A LAWYER) but a contractor. Yes, once you sign the acceptance, you are genarrly bound to the terms of the contract. Chances are, that he has already purchased the materials, schedule his crews, rented equipment (or scheduled). You could back out, but he could then collect for all of his trouble and costs involved already.
I wouldnt feel too bad though o.c. shingles are very high quality, and if installed right will last a long time.
I wouldnt ask him to meet anyone else's price, unless the contractor your dealing with is extremly high priced (2-3 times what similar companies charge). Dont base his price off just 1 other estimate. I had 5 estimates on my roof (years ago) they were from 1600-6000 dollars. And the low bidder misspelled estimate. Just make sure someone who knows a little about roofs inspects his work and compares it to what you were promised.
Sorry, if tht isnt what you wanted to hear.
I would call and talk to them. Don't try to run them off, just explain there are better prices out there. Owens Corning are not the best but not the worst. Mid-grade. Ask him to meet the other price as you are probably obligated.
First off Owens Corning is not inferior. If the new bidder said that, he just wants you to use his supplier. All should come with a warranty.
As for backing out of the deal, You will probably loss your deposit if you gave one. If the contractor threatens a law suit, call his bluff and say ok. They tend not to bother. plus your giving him 2 days notice. The shingles are not special ordered. Building supply stores carry shingles on a reg basis
Owens Corning are not great. Tell them you want Tamko.
no you signed an acceptance of proposal after that comes a contract or by law is supose to youmay show him the second quote you got see if he will at least match it if he cant dont give him the job also watch out they may drop shingles to start the job of he dont match the price dont be affraid to tell him to leave and take the stock with he may be a bully about it call the police
I don't know about whether or not they are inferior but you are definitely under obligation to the roofer you signed with. You can cancel, but you will have a cancellation fee to pay... read the fine lines... you may end up paying more if you hire the other guys and end up paying a cancellation fee too. The company you signed with won't care if you got a cheaper quote elsewhere... because you already signed with them! That only works if you haven't signed with anyone...
Sorry to give you the bad news...
Most likely depends on what state you live in. Some states by law give you three days to cancel a contract if you were to change your mind.It also should be printed in the contract.
